Terms & conditions of delivery
The terms & conditions of delivery apply to all contracts between the Seller and Buyer.

General

The Seller delivers exclusively to Buyers older than 16 years of age. When agreeing to these general terms & conditions of delivery, placing an order and making a payment, you confirm that you are older than 16 years of age.

These terms & conditions of delivery apply to all offers and contracts with the Seller regarding the sale and delivery of products and services by the Seller.

Deviations from and/or additions to these terms & conditions of delivery are only binding if and insofar as they have been agreed in writing.

If a situation arises between the parties that is not regulated by these terms & conditions of delivery, then this situation must be assessed ‘in the spirit’ of these provisions.

Offer

Any offer made by the Seller, both orally and in writing, is valid for the period stated therein. If the offer does not contain a validity period, it shall be non-binding.

In the event of a non-binding offer, the Seller has the right to revoke this offer within 2 working days after receipt of the acceptance.

If the acceptance deviates from the offer (also on minor points), the Seller is not bound by it. The contract will then not be concluded in accordance with this deviating acceptance unless the Seller agrees to this in writing.

Prices & shipping costs

Payment is based on the prices valid on the day of the order.

Shipping costs for private individuals for delivery within the Netherlands
For orders above € 50.00, VAT included, shipping is free of charge. For orders below € 50.00, VAT included, a shipping cost of € 6.00, VAT included, will be charged.

Shipping costs for health professionals for delivery within the Netherlands
For orders above € 100.00, VAT excluded, shipping is free of charge. For orders below € 100.00, VAT excluded, a shipping cost of € 7.50, VAT excluded, will be charged.

Shipping costs for private individuals for delivery within Belgium
For orders above € 75.00, VAT included, shipping is free of charge. For orders below € 75.00, VAT included, a shipping cost of € 7.50, VAT included, will be charged.

Shipping costs for health professionals for delivery within Belgium
For orders above € 100.00, VAT excluded, shipping is free of charge. For orders below € 100.00, VAT excluded, a shipping cost of € 7.50, VAT excluded, will be charged.

For shipments to other countries, different rates apply, which the Buyer can request from the Seller.

Discounts

Prices for private individuals are inclusive of VAT. Promotional campaigns may be set up by the Seller. The promotional prices are listed on the website. Voucher codes may also be distributed, giving the right to a (percentage) discount. These voucher codes are only provided by the Seller to the Buyer.

Health professionals must register in the Webshop in order to take advantage of the conditions for health professionals. Health professionals include registered prescribers and trade channels. The Seller reserves the right to request a Chamber of Commerce number, license, diploma or registration number. If this data is incorrect or cannot be provided, the Buyer will be regarded by the Seller as a consumer with the corresponding terms and conditions and prices.

The prices of the products after logging in as a health professional are exclusive of VAT.

The following graduated discounts apply to health professionals:

  • For orders with a minimum order value of € 500 (after taking into account any promotional discounts), the Buyer will receive an additional 3% discount on the order total excluding VAT.
  • For orders with a minimum order value of € 1,000 (after taking into account any promotional discounts), the Buyer will receive an additional 6% discount on the order total excluding VAT.
  • For orders with a minimum order value of € 1,500 (after taking into account any promotional discounts), the Buyer will receive an additional 9% discount on the order total excluding VAT.
  • For orders with a minimum order value of € 2,000 (after taking into account any promotional discounts), the Buyer will receive an additional 12% discount on the order total excluding VAT.

Apart from specific offers, no other discounts apply.

Deliveries

Delivery times for products that are not in stock can only be given as an approximation.

Stated periods within which the products must be delivered can never be regarded as deadlines unless the parties have expressly agreed otherwise in writing.

If the Seller is unable to deliver within the agreed delivery period, the Buyer will be immediately informed of this, stating the expected delivery period. The Buyer cannot derive any right to compensation in any form whatsoever or proceed to dissolve the contract.

Orders may be delivered and invoiced in parts. Each partial delivery shall be deemed to constitute a separate contract.

The Seller will package the products in such a way that, with normal transport, these Products will reach their destination in good condition and may be delivered.

All data relevant to the delivery of the products will be provided by the Buyer to the Seller, at the expense of the Buyer. The Buyer warrants that this information is complete and correct. The Seller shall not be liable for any damage arising from any incompleteness or inaccuracy of such information.

Payment

The Buyer can make use of various payment options to pay for the order. The Buyer can choose to pay via iDEAL, credit card, Bancontact, KBC/CBC or Klarna ‘achteraf betalen’ (pay later).
It is also possible to pay via bank transfer. The Buyer will then receive an invoice at the address provided by the Buyer, which must be paid within 14 days.

Export restrictions

The Buyer is not allowed to export the products without prior written permission.

Complaints

Complaints must be made, by telephone or in writing, within 8 working days of receipt of the goods. If a timely and justified complaint has been made and the Buyer has returned the goods, with the Seller’s consent and accompanied by the fully completed complaint form, the Seller will either redeliver the goods free of charge or credit the Buyer for the goods returned. We shall not be obliged to do more than that.

The Seller must be given the opportunity to investigate the complaint.

Packages that have been opened cannot be returned unless there is a justified complaint.

Liability

Apart from the guarantees explicitly agreed upon or given by the Seller, the Seller does not accept any liability whatsoever. The Seller is only liable for direct damage. Liability for any form of consequential damage is expressly excluded.

If the Seller is liable for damage suffered by the Buyer, the Seller’s obligation to pay compensation shall always be limited to the amount paid out by its insurer for the case in question. If the insurer does not pay out or the damage is not covered by the insurance Seller’s policy, the obligation to pay compensation shall be limited to a maximum of the invoice amount for the order in which the damage occurred.

The Seller shall not be liable to pay compensation to third parties.

The Seller is not liable if damage has arisen:

  • due to incompetent or improper use, or use of the product contrary to its intended purpose;
  • due to the use of the product contrary to the instructions, advice, directions for use, package leaflets, etc. issued by or on behalf of the Seller;
  • due to improper storing (storage) of the products.

The liability limitations included in this article do not apply if the damage is due to intent and/or deliberate recklessness on the part of the Seller or its (managerial) staff.

Late delivery by the courier or other transport services is at the risk of the Buyer.

The refusal to accept an order on presentation or the failure to collect an order after notification from the delivery service does not suspend the payment obligation.

Force majeure

If fulfilment of the contract is not possible and if this is due to a non-attributable failure on the part of the Seller and/or on the part of third parties or suppliers engaged for the performance of the contract, or in the event of any other serious reason on the part of the Seller, the Seller shall be entitled to suspend fulfilment for a period to be determined by the Seller without being obliged to pay any compensation.

The following shall be considered circumstances of non-attributable non-compliance: the failure of telecommunications and/or electricity networks, war, riots, trade embargoes, pandemics, general or partial lockdown imposed by the government concerned, mobilisation, domestic and foreign disturbances, government measures, lock-outs and strikes by workers or the threat of such circumstances; disruption of the currency exchange rate existing at the time of entering into the contract, weather conditions, operational disruptions due to fire, accident or other incidents and natural phenomena, all this irrespective of whether the non-compliance or late fulfilment takes place at the Seller’s, his suppliers or third parties engaged by the Seller for the execution of the obligation.

Applicable law, disputes, terms of acceptance

All contracts are exclusively governed by Dutch law.

By placing an order, the Buyer declares himself familiar with and in agreement with these terms and conditions.

Disputes shall be submitted to the competent court in the place where the Seller has its registered office. The Buyer is also authorised to submit the dispute to the competent court in his place of business.
